Welcome to XeroWP. These Terms of Service ("Terms") govern your access to and use of XeroWP's WordPress hosting and management platform, including our website, services, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

XeroWP provides WordPress hosting and management services, including but not limited to:

• Docker-based WordPress site deployment and hosting
• Automated backups and restoration
• File manager and database management tools
• Staging environments for testing
• SSL certificate management
• Terminal access and development tools
• Domain management and DNS configuration
• Site monitoring and analytics

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.

You agree not to use our Services to:

• Violate any laws, regulations, or third-party rights
• Distribute malware, viruses, or harmful code
• Send spam, phishing attempts, or unsolicited communications
• Engage in fraudulent, deceptive, or misleading activities
• Host or distribute illegal, infringing, or offensive content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt our Services or servers
• Use our Services for cryptocurrency mining without authorization
• Consume excessive server resources that impact other users
• Resell or redistribute our Services without permission

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.

While we provide automated daily backups as part of our Services, you are ultimately responsible for maintaining your own backups. We make reasonable efforts to ensure data integrity, but we do not guarantee that backups will always be available or complete.

We strongly recommend maintaining independent backups of your critical data.

We strive to provide reliable and consistent service, but we do not guarantee uninterrupted access to our Services. We may perform scheduled maintenance, and unexpected downtime may occur due to technical issues, security incidents, or factors beyond our control.

We are not liable for any losses resulting from service interruptions, slowdowns, or downtime.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XEROWP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

You agree to indemnify, defend, and hold harmless XeroWP and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our Services
• Your Content
• Your violation of these Terms
• Your violation of any third-party rights

You may terminate your account at any time by contacting our support team. Upon termination, your access to the Services will cease, and your data may be deleted after 30 days.

We may suspend or terminate your access to the Services immediately, without notice, for any violation of these Terms or for any other reason we deem appropriate.

Sections of these Terms that by their nature should survive termination will remain in effect, including provisions related to intellectual property, disclaimers, limitations of liability, and indemnification.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where XeroWP is registered, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using our Services and terminate your account.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and XeroWP regarding the Services.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
• Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
